Throughout these Terms of Service, the terms “SSEA,” “we,” “us,” and “our” refer to SyzygySelected LLC and its operation of the SSEA online store. The terms “you,” “your,” “user,” and “customer” refer to any person or entity that visits this website, creates an account, submits content, uses our services, or purchases our products.

SSEA offers this website, including the products, information, content, features, tools, and services available through it, conditioned upon your acceptance of these Terms of Service.

By visiting ssea.live, using any part of the website, or purchasing from us, you agree to be bound by these Terms of Service and by the additional policies referenced in them, including our:

  • Return and Refund Policy;
  • Shipping Policy;

  • Other applicable policies and notices published on the website.

If you do not agree to these Terms of Service, you should not access the website, use the services, or place an order.

1. Eligibility

Our online store is hosted on Shopify. Shopify provides the ecommerce infrastructure that enables SSEA to display products, process orders, and operate the online store.

Certain website functions may be provided or processed by Shopify or other third-party service providers, including:

  • Payment processing;
  • Customer accounts;
  • Fraud detection;
  • Shipping functionality;
  • Analytics;
  • Marketing tools; and
  • Other ecommerce services.

Your use of these functions may also be subject to the applicable third party’s terms and privacy policy.

Shopify is not the seller of the products you purchase from SSEA. Unless expressly stated otherwise, the sales contract is between you and SyzygySelected LLC, operating as SSEA.

6. Customer Accounts

Certain website features may allow or require you to create an account.

You are responsible for:

  • Providing accurate and complete account information;
  • Keeping your account information current;
  • Protecting your password and login credentials;
  • Preventing unauthorized access to your account;
  • Activities reasonably attributable to your account.

If you suspect unauthorized access or use, contact hello@ssea.live immediately.

SSEA will not ask you to send your complete account password by email.

We may suspend or close an account when we reasonably suspect:

  • Unauthorized access;
  • Fraud;
  • Abuse;
  • False information; or
  • A violation of these Terms.

7. Product Information

We make reasonable efforts to provide accurate and current product information, including:

  • Product names;
  • Images;
  • Materials;
  • Dimensions;
  • Capacity;
  • Color;
  • Price;
  • Availability;
  • Use and care information.

However, to the extent permitted by law, we cannot guarantee that all product information will always be completely free from:

  • Typographical errors;
  • Description errors;
  • Measurement variations;
  • Image differences;
  • Pricing errors;
  • Inventory-update delays; or
  • Other unintentional inaccuracies.

If we discover a material error, we may correct the information, contact the customer, refuse or cancel the affected order, or offer another reasonable resolution.

If payment has already been collected for a canceled order, the applicable amount will be refunded to the original payment method.

8. Handmade Variations

SSEA products may be handmade or finished using processes that naturally produce variation.

Reasonable differences may occur in:

  • Shape;
  • Dimensions;
  • Weight;
  • Glaze color;
  • Surface texture;
  • Pattern;
  • Speckling;
  • Hand-applied details;
  • Placement of decorative elements; and
  • Other characteristics inherent to handmade production.

These variations are part of the individual character of handmade ceramics and do not necessarily constitute a defect or failure to conform to a product description.

Actual colors may also appear slightly different from website images because of photography, lighting, screen calibration, device settings, and natural glaze variation.

Nothing in this section limits a customer’s rights concerning shipping damage, material defects, or an incorrect item.

9. Product Use and Care

Customers are responsible for reading and following all applicable:

  • Product descriptions;
  • Use instructions;
  • Care instructions;
  • Safety notices; and
  • Product limitations.

Unless a product page expressly states otherwise, you should not assume that a product is:

  • Microwave safe;
  • Dishwasher safe;
  • Oven safe;
  • Suitable for direct flame;
  • Resistant to sudden temperature changes; or
  • Suitable for another specialized use.

Damage resulting from failure to follow product instructions, care requirements, or reasonable safety precautions may not qualify as a product defect.

Stop using any ceramic item that develops a crack, severe chip, or other damage that could make continued use unsafe.

10. Prices

Unless otherwise stated, prices are displayed in U.S. dollars.

Product prices may change without notice. Price changes will not ordinarily affect an order already accepted by SSEA, except in cases involving:

  • An obvious pricing error;
  • A system error;
  • Fraud; or
  • Another circumstance in which correction is permitted by law.

Product prices generally do not include:

  • Sales tax;
  • Shipping charges;
  • Expedited or Express delivery charges; or
  • Other applicable charges displayed at checkout.

The checkout total will include charges that can reasonably be calculated when the order is submitted.

11. Taxes

Applicable sales tax will be calculated at checkout based on factors such as:

  • Shipping address;
  • Products ordered;
  • Applicable tax rates; and
  • Legal requirements.

Customers are responsible for providing accurate shipping and billing information.

SSEA may collect or adjust taxes when required by an applicable taxing authority or law.

12. Payment

You agree to pay all charges applicable to orders submitted through your account or payment method.

By submitting payment information, you represent that:

  • You are authorized to use the payment method;
  • The information is accurate;
  • You authorize SSEA and its payment providers to process the payment;
  • You agree to pay the order total and applicable charges.

Payments may be processed through Shopify Payments, Shop Pay, PayPal, card networks, or other third-party payment providers.

SSEA does not directly store complete payment-card numbers. Payment providers may process payment information under their own terms and privacy policies.

We may use reasonable fraud-prevention and verification measures, including requesting that a customer:

  • Confirm order information;
  • Verify a payment method;
  • Provide additional identity or address information; or
  • Complete verification required by a payment provider.

An order may be delayed, refused, or canceled if required verification is not completed.

13. Order Submission and Acceptance

Adding a product to your cart does not mean that:

  • The product has been reserved;
  • The price has been locked;
  • Availability is guaranteed; or
  • SSEA has accepted the order.

An order confirmation generally means that we received your order. It does not necessarily mean that the order has been finally accepted or shipped.

Orders are generally accepted after payment authorization, order review, and fulfillment processing.

SSEA may reasonably refuse, limit, or cancel an order because of:

  • Product unavailability;
  • A pricing or description error;
  • Payment failure;
  • An unverifiable address;
  • Suspected fraud;
  • An unusual purchase quantity;
  • Suspected unauthorized resale;
  • A policy violation;
  • Carrier restrictions; or
  • Another reasonable operational issue.

If an order is canceled after payment has been collected, the applicable amount will be refunded.

14. Purchase Limits and Resale

SSEA may impose reasonable limits on:

  • Product quantities;
  • Order quantities;
  • Purchases associated with one account;
  • Purchases sent to one address;
  • Purchases using one payment method;
  • Promotional merchandise.

If we reasonably believe that an order is intended for unauthorized bulk resale, inventory hoarding, commercial resale, or circumvention of purchase limits, we may restrict or cancel the order.

15. Promotions and Discount Codes

Promotions, discounts, and promotional codes are subject to the applicable offer terms and these Terms of Service.

Unless expressly stated otherwise:

  • Offers apply only during the stated promotional period;
  • Offers cannot be exchanged for cash;
  • Offers cannot be applied retroactively;
  • Offers cannot be combined;
  • Only one promotional code may be used per order;
  • Gift-card purchases may be excluded;
  • Shipping offers may be limited by destination or service;
  • A return may cause promotional eligibility to be recalculated.

If promotional information conflicts with checkout information, contact SSEA before submitting the order.

SSEA may correct an obvious promotional error but will not arbitrarily withdraw a valid promotion after accepting an eligible order.

16. Shipping

All orders are subject to the SSEA Shipping Policy.

Delivery time includes:

  1. SSEA’s order-processing time; and
  2. Carrier transit time.

Estimated delivery dates are not guaranteed unless the applicable carrier service expressly provides a delivery guarantee.

Customers are responsible for providing an accurate and complete delivery address and making reasonable arrangements to receive shipments.

Our Shipping Policy contains additional terms concerning:

  • Shipping destinations;
  • Processing time;
  • Carriers;
  • Shipping charges;
  • Free shipping;
  • Address errors;
  • Delivery delays;
  • Lost shipments;
  • Packages marked delivered but not received;
  • Shipping damage; and
  • Returned-to-sender packages.

17. Returns and Refunds

All returns, refunds, exchanges, damage reports, and product-defect claims are subject to the SSEA Return and Refund Policy.

Customers must submit requests within the applicable period and provide reasonably required information and evidence.

Returning an item without authorization does not guarantee a refund.

If these Terms conflict with the Return and Refund Policy regarding a specific return or refund matter, the Return and Refund Policy will control, except where applicable law requires otherwise.

18. Gift Cards

If SSEA offers gift cards, their purchase and use are subject to the following rules:

  • Gift cards may be used only through sales channels authorized by SSEA;
  • Gift cards cannot be redeemed for cash except where required by law;
  • Gift cards may not be used for an illegal, fraudulent, or unauthorized purpose;
  • Customers are responsible for protecting gift-card codes;
  • SSEA is not responsible for unauthorized use caused by a customer’s disclosure of a gift-card code, except where required by law.

Gift-card expiration and other restrictions will comply with applicable law.

19. Intellectual Property

The website and its content may be protected by copyright, trademark, trade-dress, and other intellectual-property laws.

Unless otherwise stated, SSEA or its licensors own the applicable rights in:

  • The SSEA name and branding;
  • Product names;
  • Original product designs;
  • Product photography;
  • Videos;
  • Text;
  • Journal and Blog articles;
  • Graphics;
  • Page designs;
  • Illustrations;
  • Icons; and
  • Other original brand content.

Without prior written permission, you may not:

  • Copy;
  • Modify;
  • Publish;
  • Distribute;
  • Sell or resell;
  • Create derivative works from;
  • Remove rights notices from;
  • Include in a commercial content database;
  • Use for unauthorized commercial AI or machine-learning training; or
  • Otherwise commercially exploit protected content.

You may reasonably access and use the website for personal, noncommercial shopping purposes.

This restriction does not prohibit lawful search indexing by search engines and services permitted through our technical settings, nor does it limit fair use or other rights provided by applicable law.

20. User-Submitted Content

The website may allow users to submit:

  • Product reviews;

  • Feedback; and

By submitting content, you represent that:

  • You own the content or have authority to submit and license it;

To the extent permitted by law, you grant SSEA a nonexclusive, worldwide, royalty-free license to use, reproduce, display, format, publish, and distribute voluntarily submitted content for operating, displaying, and reasonably promoting the store and its products.

You retain ownership of your content.

Material use of customer content in paid advertising or another use substantially beyond normal website and owned-channel promotion may require additional permission, depending on applicable law and the circumstances.

SSEA may, but is not obligated to, monitor, edit, or remove content that violates these Terms.

21. Product Reviews

Product reviews should reflect genuine experiences.

Users must not:

  • Submit false reviews;
  • Impersonate another person;
  • Misrepresent an experience with a product;
  • Accept an undisclosed benefit in exchange for a review;
  • Repeatedly submit duplicate content;
  • Use a review to harass another person;
  • Publish unrelated advertising or links.

If a review results from a free product, discount, collaboration, or other material relationship, the user must make any disclosure required by applicable law.

SSEA will not remove a review merely because it expresses a negative opinion. We may remove content that violates these Terms, lacks authenticity, or contains unlawful material.

22. Prohibited Uses

You may not use the website or services to:

  • Engage in unlawful activity;
  • Commit fraud or identity theft;
  • Infringe intellectual-property rights;
  • Harass, threaten, abuse, or discriminate against another person;
  • Submit false or misleading information;
  • Transmit malicious code;
  • Collect user information without authorization;
  • Scrape or reproduce website content for an unauthorized commercial purpose;
  • Interfere with website or server security;
  • Circumvent access restrictions;
  • Test or attack system vulnerabilities;
  • Manipulate reviews, prices, inventory, or promotions;
  • Use automated tools to make bulk purchases or evade purchase limits;
  • Engage in conduct that could harm SSEA, Shopify, customers, or third parties.

We may investigate suspected violations and, where appropriate, restrict access, cancel orders, close accounts, preserve evidence, or report conduct to relevant authorities.

The website may contain links to third-party websites, social-media platforms, applications, payment services, and other external resources.

SSEA does not control all third-party services and does not guarantee their:

  • Content;
  • Accuracy;
  • Security;
  • Availability;
  • Privacy practices;
  • Products or services; or
  • Business conduct.

Review the applicable terms and privacy policies before using a third-party service.

Transactions, communications, and disputes between you and a third party are generally between you and that third party, except where applicable law provides otherwise.

26. Errors, Inaccuracies, and Omissions

If an order is canceled because of an SSEA error, applicable amounts already collected will be refunded.

  • Suspend portions of the services;
  • Discontinue a product;
  • Perform maintenance.

To the extent permitted by law, we do not guarantee that any product, feature, or service will remain permanently available.

We will continue to handle accepted orders under the applicable policies unless performance becomes impossible because of a reasonable circumstance outside our control.

28. Website Availability

We make reasonable efforts to maintain the website, but we do not guarantee that it will always be:

Unless expressly stated otherwise, this content is not:

Nothing in these Terms excludes consumer rights that cannot lawfully be excluded.

31. Limitation of Liability

To the maximum extent permitted by applicable law, SyzygySelected LLC, SSEA, and their owners, officers, employees, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, special, punitive, consequential, or similar losses arising from use of or inability to use the website, services, or products, including:

  • Lost profits;
  • Lost revenue;
  • Lost data;
  • Lost business opportunities; or
  • Similar economic losses.

To the extent permitted by law, SSEA’s total liability concerning a particular order, product, or service will not exceed the amount the customer actually paid to SSEA for the order or product giving rise to the claim.

These limitations do not apply to liability that cannot lawfully be limited or excluded, which may include:

  • Fraud;
  • Intentional misconduct;
  • Gross negligence;
  • Personal injury;
  • Nonwaivable product liability;
  • Statutory consumer rights; or
  • Other liability that applicable law prohibits us from limiting.

32. Indemnification

To the extent permitted by applicable law, if a third party brings a claim against SSEA because of your material breach of these Terms, unlawful use of the services, infringement of third-party rights, submission of unlawful content, fraud, or intentional misconduct, you agree to be responsible for resulting losses and reasonable costs.

This section does not require a consumer to indemnify SSEA for SSEA’s own negligence, unlawful conduct, or liability that cannot lawfully be transferred.

33. Force Majeure

SSEA will not be responsible for delay or failure caused by events beyond our reasonable control, including:

  • Natural disasters;
  • Severe weather;
  • Fire or flood;
  • Epidemics or public-health emergencies;
  • War or terrorism;
  • Government action;
  • Labor disruption;
  • Transportation interruption;
  • Supply-chain disruption;
  • Network or power failure;
  • Major carrier disruption; or
  • Other force-majeure events.

We will make reasonable efforts to reduce the impact and perform obligations that remain possible.

This section does not eliminate a customer’s right to a refund or another nonwaivable remedy for products that are not provided.

34. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable by a court with proper jurisdiction, the provision will be limited or separated only to the minimum extent necessary.

The remaining provisions will continue in effect.

35. No Waiver

SSEA’s failure to immediately enforce a right under these Terms does not permanently waive that right.

A waiver concerning one violation does not waive a later or different violation.

Any express waiver must be made in writing.

36. Assignment

You may not transfer your rights or obligations under these Terms without SSEA’s prior written consent.

To the extent permitted by law, SSEA may transfer its rights and obligations in connection with a reorganization, merger, acquisition, sale of assets, business transfer, or transfer to an affiliate.

Any transfer will not reduce a consumer’s rights under applicable law.

37. Entire Agreement

These Terms and the policies referenced in them constitute the complete agreement between you and SSEA concerning the website and services.

They replace prior oral or written communications concerning the same subject, except for specific order confirmations, product warranties, or other express written commitments made by SSEA.

If these Terms conflict with a more specific policy:

  • The Shipping Policy controls shipping matters;
  • The Return and Refund Policy controls return and refund matters;
  • The Privacy Policy controls personal-information matters;
  • Express product-page disclosures control product-specific matters;

except where applicable law requires otherwise.

38. Governing Law

These Terms and disputes arising from the website, services, or purchase of products are governed by the laws of the State of New York, without regard to conflict-of-law rules.

This choice of law does not deprive a consumer of mandatory consumer-protection rights available under the laws of the consumer’s place of residence.

39. Dispute Resolution and Jurisdiction

If a dispute arises, customers are encouraged to contact hello@ssea.live first so that the parties can attempt to resolve the matter through good-faith communication.

If a dispute cannot be resolved informally, and applicable law permits, legal proceedings may be brought in a state or federal court with appropriate jurisdiction in New York.

Nothing in this section prevents a consumer from:

  • Filing a complaint with a government regulator;
  • Seeking assistance from a consumer-protection agency;
  • Using an eligible small-claims court; or
  • Exercising another right provided by applicable law.

These Terms do not require mandatory arbitration and do not include a class-action waiver.

SSEA may update these Terms to reflect changes in:

  • Products or services;
  • Operational requirements;
  • Shopify functionality;
  • Legal and regulatory requirements; or
  • Business practices.

Updated Terms will be posted on this page with a revised “Last updated” date.

Unless applicable law requires otherwise, material changes will generally apply to use of the website and services after the changes become effective.

We will not use an update to retroactively remove a statutory consumer right that has already arisen.
